Terms of service
Last updated: October 12, 2026
Overview
Welcome to Aparry. The terms “we”, “us” and “our” refer to Aparry, a business based in Quebec, Canada. Aparry operates this store and website, including all related information, content, features, tools, products and services (the “Services”).
These terms and conditions, together with the policies referenced in them (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, including warranty disclaimers and limitations of liability.
By visiting, interacting with or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
Your rights as a consumer. Nothing in these Terms limits or excludes any right you have under consumer protection laws that apply to you and cannot be waived, including Quebec’s Consumer Protection Act. Where these Terms conflict with those laws, the laws prevail.
1. Access and account
By agreeing to these Terms, you confirm that you are at least the age of majority in your province, state or country of residence, or that you are using the Services with the involvement of a parent or guardian.
To use the Services, including to buy products, you may be asked to provide information such as your email address and your billing, payment and shipping details. You confirm that the information you provide is correct, current and complete.
If you create an account, you are responsible for keeping your login details secure and for all activity on your account. You may not transfer, sell or assign your account to anyone else.
2. Our products
Our items are made to order: we start producing your item after you place your order, as described in our Shipping Policy.
We make every effort to show our products accurately. However, colours and appearance may look different on your screen depending on your device and its settings, and small variations can occur between made-to-order items.
Product descriptions may change at any time. We may discontinue any product at any time and may limit the quantities we sell to any person, region or jurisdiction.
3. Orders
When you place an order, you are making an offer to buy. Your order is accepted when we confirm it by email. We may decline or cancel an order, for example if a product is unavailable, if we suspect fraud, or if there is an obvious error in the price or description. If we cancel an order after you have paid, we will refund you in full.
Please review your order carefully before submitting it. Because items are made to order, we may not be able to cancel or change an order once production has started. Contact us as soon as possible at support@aparry.com if you need to make a change.
Returns and exchanges are handled according to our Refund Policy.
You confirm that your purchases are for your own personal or household use and not for commercial resale.
4. Prices and payment
Our prices are set in Canadian dollars (CAD). Depending on where you are visiting from, prices may be shown in US dollars, euros or Mexican pesos instead, converted from CAD. The currency shown at checkout is the currency you are charged in. Prices, discounts and promotions may change without notice, but the price you pay is the price shown when you place your order, as confirmed in your order confirmation email. Shipping charges are shown at checkout. Any applicable taxes are shown at checkout before you pay.
Orders shipped outside Canada may be subject to import duties, taxes and customs fees charged by the destination country. These charges are not included in our prices or shipping charges and are your responsibility.
Payments are processed securely by our payment processor. Your payment is charged when you place your order. If your card is issued in another currency, your bank may apply its own exchange rate and fees.
From time to time we may offer promotions or discount codes with their own conditions. If promotion terms conflict with these Terms, the promotion terms apply to that promotion.
You confirm that the payment information you provide is accurate and that you are authorized to use the payment method.
5. Shipping and delivery
Processing and delivery times are estimates and are explained in our Shipping Policy. We are not responsible for delays caused by carriers, customs or other events outside our control, except as required by law. Risk of loss passes to you when your order is delivered to the shipping address you provided.
6. Intellectual property
The Services, including all trademarks, text, designs, images, graphics, video and the selection and arrangement of this content, are owned by Aparry or its licensors and are protected by Canadian and international copyright, trademark and other intellectual property laws.
You may use the Services for your personal, non-commercial use only. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, republish or sell any material from the Services without our prior written permission. Aparry’s name, logos, product names, designs and slogans are trademarks of Aparry. All other names and trademarks shown on the Services belong to their respective owners.
Our designs are fan-inspired. Aparry is an independent retailer and is not affiliated with, endorsed by or sponsored by any anime studio, publisher or rights holder referenced on the Services. To report a concern about intellectual property, please see our DMCA Policy.
7. Service providers and third-party tools
We use third-party service providers to run the store, including website hosting, payment processing and email delivery providers. Any purchase you make on the Services is made directly with Aparry.
Some features of the Services, such as Apple Pay or Google Pay, are provided by third parties under their own terms. We provide these tools “as is” and you use them at your own discretion.
8. Third-party links
The Services may contain links to websites operated by third parties. We are not responsible for their content, products or practices. Please review their terms and privacy policies before using them.
9. Privacy
Personal information we collect through the Services is handled according to our Privacy Policy.
10. Feedback
If you send us ideas, suggestions, reviews, photos or other content (“Feedback”), you grant us a non-exclusive, perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and display that Feedback in any medium, including to promote the Services. We will not use your name or photos of you in our marketing without your permission.
You confirm that you have the right to share your Feedback, that it does not infringe anyone’s rights, and that it does not contain unlawful, abusive or obscene content or malicious code. We are not required to keep Feedback confidential, pay for it or respond to it, and we may remove any Feedback at our discretion.
11. Errors and omissions
Information on the Services may occasionally contain errors, inaccuracies or omissions, for example in product descriptions, prices, promotions, shipping charges, delivery times or availability. We may correct these at any time. If an error affects an order you have already placed, we will contact you and, where the law allows, give you the choice to continue at the correct price or cancel for a full refund.
12. Prohibited uses
You may use the Services for lawful purposes only. You may not use the Services: (a) for any unlawful or malicious purpose; (b) to violate any law or regulation; (c) to infringe our intellectual property rights or anyone else’s; (d) to harass, abuse, threaten or defame any person; (e) to send false or misleading information; (f) to send spam or unsolicited advertising; (g) to impersonate any person or entity; or (h) in any way that harms Aparry or other users, or interferes with anyone’s use of the Services.
You also agree not to: (a) upload or transmit viruses or other malicious code; (b) copy, scrape, resell or exploit any part of the Services; (c) collect the personal information of others; (d) use robots, scrapers or other automated tools, including AI agents, to access the Services except as allowed in section 13; or (e) bypass or interfere with any security or access-control measure. We may suspend or close your access or account if you violate these Terms.
13. Automated agents
An “Agent” is any software or service that acts autonomously or semi-autonomously on behalf of a person, such as an AI shopping assistant. An Agent may only access or use the Services if it: (i) identifies itself in every request by including “Agent/Aparry” in its user agent string; (ii) does not hide that it is an Agent, mimic human behaviour or bypass CAPTCHAs or similar measures; (iii) answers truthfully when asked whether it is a human or a computer; and (iv) does not try to get around any measure we use to limit or control Agents. We may limit or block Agent access at any time.
14. Termination
We may suspend or end your access to the Services if you violate these Terms. You remain responsible for any amounts owed up to that date. Sections that by their nature should continue to apply (including intellectual property, feedback, disclaimers, limitation of liability, indemnification and governing law) survive termination.
15. Disclaimer of warranties
Information on the Services is provided for general information only. Except as expressly stated by Aparry and to the extent permitted by law, the Services are provided “as is” and “as available”, and we do not promise that they will be uninterrupted, timely, secure or error-free.
This section does not affect the legal warranties that apply to the products you buy, including the warranties of quality, fitness for normal use and reasonable durability provided by Quebec’s Consumer Protection Act and similar laws where you live. Some jurisdictions do not allow certain warranties to be excluded, so parts of this section may not apply to you.
16. Limitation of liability
To the fullest extent permitted by applicable law, Aparry and our partners, employees, contractors, service providers and licensors will not be liable for indirect, incidental, special, punitive or consequential damages, or for lost profits, revenue, savings or data, arising from your use of the Services or any product bought through them. To the extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order.
Nothing in these Terms limits our liability for damage we cause intentionally or through gross negligence, for bodily or moral injury, or in any other case where the law does not allow it to be limited. Some jurisdictions, including Quebec for consumer contracts, do not allow certain limitations, so parts of this section may not apply to you.
17. Indemnification
To the extent permitted by law, you agree to indemnify Aparry and our partners, employees, contractors and service providers against third-party claims, losses and reasonable legal fees arising from your breach of these Terms, your violation of any law or anyone’s rights, or your misuse of the Services.
18. Severability
If any part of these Terms is found to be unlawful, void or unenforceable, that part will be enforced to the extent permitted by law, and the rest of these Terms will remain in effect.
19. Waiver and entire agreement
If we do not enforce a right or provision of these Terms, that does not mean we have waived it. These Terms, together with the policies posted on the Services, are the entire agreement between you and us about the Services and replace any earlier versions.
20. Assignment
You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours, for example if our business is sold, as long as this does not reduce your rights.
21. Governing law
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. If you are a consumer, you also keep the protection of the mandatory laws of the place where you live, and you may bring a claim before the courts of your place of residence where the law allows.
22. Changes to these Terms
You can review the current version of these Terms at any time on this page. We may update them from time to time by posting the new version here. Changes do not apply to orders already placed. We will give notice of material changes where required by law.
